A Mineral County man who's charged with assault of a minor for slamming a child to the ground during the national anthem in Superior entered a not guilty plea on Wednesday morning.

The child was flown to Spokane after receiving temporal skull fractures in the incident and is back home recovering.

Brockway was arrested on Aug. 3 and made his initial court appearance on Aug. 5 in Mineral County.

The state had requested his bond be set to $100,000, however the judge ruled Brockway can be released on his own recognizance.

This is not Brockway’s first run in with police. He pleaded guilty to an assault with a weapon charge that occurred in 2011.

We will full coverage of Wednesday's hearing during the 5:30 News.
